Terms & Conditions

These Terms & Conditions (“Terms”) govern purchases and use of digital products offered under the ENY Studio brand. ENY Studio is operated by Broadwise, registered in the Netherlands under KVK number 75889897 and VAT ID NL003030786B78 (“ENY Studio”, “we”, “us”, “our”).

These Terms apply to customers in the Netherlands, the European Union / European Economic Area and other countries where our products are lawfully offered. Mandatory consumer rights that apply in a customer’s country of residence remain unaffected.

1.1 Business details

1.2 Digital products

We sell digital products such as downloadable PDF guides, educational materials, examples, prompt libraries, reference materials, templates and related digital content. No physical goods are supplied unless a product page expressly says otherwise.

Product descriptions, contents, language, version, price, included files and any stated update policy are shown on the relevant sales page before purchase.

1.3 Orders, prices and payment

Prices are displayed before checkout. Applicable VAT, sales tax or similar taxes may be included in the displayed price or calculated at checkout depending on the customer’s location and the payment model used.

Payments may be processed by an external payment provider or Merchant of Record. The payment provider may apply its own terms and privacy notice. ENY Studio does not intentionally store full payment-card details on its own website.

An order is accepted when payment has been successfully completed and the customer receives confirmation or access to the digital product.

1.4 Delivery

Digital products are normally delivered electronically after successful payment, for example by download page, secure link, account access or e-mail. Customers must provide accurate information where required for delivery.

If access fails because of a technical problem attributable to us, contact info@enystudio.eu and we will take reasonable steps to restore access or provide another remedy required by applicable law.

1.5 Consumer right of withdrawal for digital content

Consumers in the EU/EEA may have a statutory right to withdraw from certain distance contracts. For digital content supplied immediately, that right can be lost after supply begins where the law permits this and the customer has first expressly consented to immediate performance and acknowledged the loss of the withdrawal right.

Where legally required, the checkout will therefore ask for explicit consent before immediate access or downloading begins. Nothing in these Terms removes mandatory rights relating to defective, inaccessible or non-conforming digital content.

If a statutory withdrawal right still applies in a particular case, it will be honoured in accordance with applicable law.

1.6 Refunds

Because digital files can be accessed or downloaded immediately, purchases are generally non-refundable after lawful immediate supply has begun and any applicable withdrawal right has been validly waived or lost. This does not affect mandatory consumer remedies for defective, corrupted, inaccessible or non-conforming digital content, or any other non-waivable legal rights.

1.7 Licence

A purchase gives the individual purchaser a limited, personal, non-exclusive, non-transferable licence to use the digital product for personal use or the purchaser’s own internal professional use, unless a product page expressly grants broader rights.

A purchase does not transfer copyright, ownership or other intellectual-property rights in the product.

Original text, layouts, graphics, illustrations, prompt structures, examples, educational materials, branding and other original content in ENY Studio products are protected by applicable copyright and intellectual-property laws.

Unless we give prior written permission, you may not:

Unauthorised copying, sharing, resale or distribution may constitute both a breach of these Terms and an infringement of intellectual-property rights. We may request takedown of unauthorised copies and pursue remedies available under applicable law.

1.9 Client work and use of techniques

Unless a specific product licence says otherwise, customers may apply general techniques, workflows and knowledge learned from a guide in their own creative work or client work. The restriction is on copying, redistributing or reselling ENY Studio’s protected materials themselves, not on independently applying learned skills.

1.10 Third-party tools, platforms and trademarks

Our products may refer to third-party software, AI models, platforms and services. Third-party names, trademarks and logos remain the property of their respective owners. Unless expressly stated, ENY Studio is independent from and is not sponsored, endorsed or affiliated with those third parties.

Third-party interfaces, models, pricing, policies and functionality can change after publication. We do not control those changes.

1.11 Educational and informational nature

Guides and examples are provided for educational and informational purposes. Results may vary depending on software versions, AI models, user inputs, platform rules and other factors. We do not guarantee any particular creative, commercial, financial, audience-growth or business outcome.

1.12 Updates and availability

Unless a sales page expressly states that future updates are included, a purchase relates to the version available at the time of purchase. Mandatory legal obligations to provide necessary updates or remedies remain unaffected.

Temporary interruptions may occur because of hosting, maintenance, payment processors, e-mail providers, internet failures or third-party services. We will use reasonable efforts to resolve access issues within our control.

1.13 Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law. To the extent permitted by law, ENY Studio is not liable for indirect or consequential losses caused solely by reliance on educational material or by changes, restrictions, downtime or discontinuation of third-party services.

For consumers, any limitation in these Terms applies only to the extent legally permitted and does not reduce mandatory statutory rights.

1.14 Governing law and disputes

These Terms are governed by the laws of the Netherlands. If you are a consumer, this choice of law does not deprive you of mandatory consumer protections that apply to you under the law that would otherwise be applicable in your country of residence.

Courts or dispute-resolution bodies will have jurisdiction as determined by applicable law. Nothing in this clause prevents a consumer from relying on mandatory jurisdiction rules available to them.

1.15 Changes to these Terms

We may update these Terms for future purchases to reflect changes to our products, business operations or legal requirements. The version made available at the time of a purchase will normally apply to that purchase, subject to mandatory law.
